Terms of Use and End-User Licence Agreement (EULA) – Crumb Counter (iOS and Android)

1. Provider and scope

These Terms of Use apply to the “Crumb Counter” (“Krümelzähler”) app for iOS and Android, including the services made available through it.

These Terms also constitute the end-user licence agreement for the app. The Subscription Terms and Privacy Policy apply in addition. The terms of the Apple App Store or Google Play also apply to downloads, payments, billing, refunds and store management. Mandatory statutory rights prevail over conflicting provisions.

2. Formation of the agreement, account and minimum age

The usage agreement is formed when, after these Terms have been made available, you install or use the app, create an app account or provide any required acceptance. A paid subscription is formed only when you separately confirm a purchase in the Apple App Store or Google Play.

The app is intended for persons aged 16 or over. If you do not have full legal capacity under the law applicable to you, you may use the app and, in particular, paid offers only with the consent of your parent or legal guardian.

Online functions use sign-in with Apple or Google. You must protect your platform credentials, must not transfer your app account and must notify us without undue delay if you suspect misuse. You are responsible for the accuracy of your information and for ensuring that use of your store account for a purchase is authorised.

3. Purpose of the app and medical notice

Crumb Counter is intended for personal documentation of nutrition, weight, water intake, vital measurements and optional GLP-1-related information. The app is not a medical device and does not replace medical advice, diagnosis or treatment. It is not intended for emergencies.

Calorie, nutrition, AI, trend and other analyses are non-binding estimates and may be incorrect or incomplete. In particular, medication dosage, treatment or other medical decisions must not be based solely on information provided by the app. If you have health concerns or questions, consult a qualified healthcare professional; in an emergency, contact your local emergency service.

4. Free and paid functions

The app can be used without a paid subscription with the functions currently designated as free basic functions. Certain functions are marked “Premium” and require an active free Premium access period, a paid subscription or another entitlement expressly granted to you.

The functions currently available for free or as Premium are described in the app and before purchase. PepperTools may determine whether new functions are offered free of charge or as paid functions. Essential Premium benefits promised for a paid period will not be withdrawn during that period without a legally permissible reason.

The one-time ten-day free Premium access and paid subscriptions are governed by the Subscription Terms.

5. Licence

For the term of this agreement, PepperTools grants you a personal, non-exclusive and non-transferable licence to install and use the app for private, non-commercial purposes on compatible devices that you own or control. The licence ends in accordance with section 10. The usage rules of the relevant store continue to apply.

Except where expressly permitted by law, you must not:

  • copy, rent, sell, sublicense or publicly make available the app or any part of it;
  • derive source code, circumvent safeguards, modify the app or create derivative works;
  • transfer, share, manipulate or fraudulently obtain accounts, Premium entitlements, free access periods or purchase records;
  • use interfaces in an automated or abusive manner or circumvent technical limits;
  • use the app for unlawful, deceptive or harmful purposes or to infringe third-party rights.

Mandatory rights, including legally permitted interoperability, error correction and use of open-source components under their respective licences, remain unaffected.

6. Your content and backups

You may process only photos, files, URLs and other content that you are entitled to use. In particular, do not upload unlawful content or unnecessary third-party data. Solely to provide the function selected by you, you grant PepperTools the limited right to transmit, temporarily reproduce and automatically process that content. No broader right of use is granted.

Much of your data is stored only locally on your device. You are responsible for protecting your device and making any necessary backups or exports. Local data may be lost through uninstallation, loss or failure of the device, or deletion initiated by you. Details about data processing, online backup and deletion are provided in the Privacy Policy.

7. External services and platforms

Certain functions use services provided by Apple, Google, OpenAI or Open Food Facts, or access websites and storage services selected by you. Additional terms and privacy notices of the relevant provider may apply. You must comply with applicable third-party terms.

PepperTools does not have complete control over the availability, content or technical changes of independent third parties. Statutory claims against PepperTools for its own fault or contractual obligations remain unaffected.

8. Availability, maintenance and changes

PepperTools aims to operate the app securely and reliably but does not promise uninterrupted availability at all times. Maintenance, security measures, network or platform outages and events outside our reasonable control may temporarily restrict functions.

Updates may be required for security, compatibility or legal compliance. PepperTools may develop, replace or discontinue functions for objective reasons, including security risks, technical or legal changes, unavailable third-party services or disproportionate operating effort. Legitimate user interests will be taken into account. Mandatory update, conformity, warranty and refund rights for digital products remain unaffected.

9. Premium subscriptions

Premium subscriptions are purchased and managed exclusively through the Apple App Store or Google Play. The price, currency, tax, term and billing date are shown in the relevant store before purchase. PepperTools does not receive complete payment-instrument data.

The Subscription Terms govern free Premium access, subscription periods, automatic renewal, cancellation, restoration, price changes and refunds. Deleting the app account or uninstalling the app does not cancel a store subscription.

10. Term, suspension and termination

You may stop using the free service at any time and request deletion of your app account through the methods available in the app or on the public deletion page.

PepperTools may temporarily restrict access or terminate the usage agreement for good cause, including a material or repeated breach of these Terms, fraud, manipulation of purchases or free access, a security threat or a mandatory legal obligation. Where reasonably possible, you will first receive notice and an opportunity to remedy the breach. Paid rights and mandatory consumer rights remain unaffected. Whether and how a refund is provided is governed by the published withdrawal and refund policy, the relevant store rules and applicable law; PepperTools reviews direct requests under those standards.

When the agreement ends, the licence ends. Provisions that by law or their nature continue to apply, including those concerning intellectual property, liability, payment records and privacy, remain in effect.

11. Intellectual property

The app, its source code, design, text, graphics, data structures and marks are legally protected. All rights not expressly granted remain with PepperTools or the respective rights holder. Content from independent data providers is governed by their own licence terms.

12. Conformity and warranties

Consumers retain all mandatory statutory conformity and warranty rights for digital products. No particular medical, nutritional or economic outcome is promised. Non-binding estimates, user input and information from independent data sources do not constitute a guarantee.

13. Liability

PepperTools has unlimited liability for intent and gross negligence, culpable injury to life, body or health, liability under the German Product Liability Act, expressly assumed guarantees and all other cases of mandatory statutory liability.

For a slightly negligent breach of an essential contractual obligation, liability is limited to damage that was foreseeable and typical for the agreement when it was made. Essential obligations are those whose performance is necessary for proper implementation of the agreement and on whose performance you may regularly rely. Liability for other cases of slight negligence is excluded. These rules also apply to legal representatives and agents.

If you fail to make a reasonable backup despite an appropriate notice, liability for recoverable data loss is limited to the typical restoration effort. The mandatory cases of liability above remain unaffected.

14. Special terms for Apple users

The following additional terms apply to the iOS app obtained through the Apple App Store:

  1. This agreement is concluded solely between you and PepperTools, not Apple. PepperTools alone is responsible for the app and its content.
  2. The licence is limited to a non-transferable right to use the app on Apple-branded products that you own or control, as permitted by the Apple Media Services Usage Rules. Family Sharing or volume purchasing is permitted only to the extent allowed by Apple and the specific offer.
  3. PepperTools is responsible for maintenance and support required by contract or law. Apple has no obligation to provide maintenance or support. App support is available at support@peppertools.de.
  4. If the app fails to conform to an applicable warranty, you may notify Apple. Apple will refund any purchase price paid for the app. To the maximum extent permitted by law, Apple has no other warranty obligation; PepperTools is responsible for other claims arising from a failure to conform.
  5. PepperTools, not Apple, is responsible for claims relating to the app or its use, including product-liability, consumer, privacy and regulatory claims, including claims concerning Apple Health or HealthKit.
  6. If a third party claims that the app or its use infringes intellectual property rights, PepperTools, not Apple, is responsible for investigating, defending, settling and discharging that claim.
  7. You represent that you are not located in a country subject to a United States Government embargo or designated by it as a country supporting terrorism, and that you are not listed on a United States Government list of prohibited or restricted parties.
  8. You must comply with applicable third-party agreements when using the app, including the terms of your mobile, internet, Apple and storage-service providers.
  9. Apple and its subsidiaries are third-party beneficiaries of this agreement and, after your acceptance, may enforce the Apple-related provisions against you.

15. Special terms for Google Play users

The Google Play usage and payment terms additionally apply to the Android app obtained through Google Play. Google is not the provider or licensor of the app. PepperTools remains responsible for the app, its content, support and app-related claims. Billing, store cancellation and store refunds are processed in accordance with Google Play’s terms.

16. Governing law and dispute resolution

German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. For consumers, this choice of law does not deprive them of mandatory protection under the law of their country of habitual residence. Statutory places of jurisdiction apply to consumers. If the user is a merchant, a legal entity under public law or a special fund under public law, Delmenhorst is the exclusive place of jurisdiction to the extent legally permitted.

PepperTools is neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration board.

17. Changes to these Terms

PepperTools may amend these Terms for the future where required by changes in law, store rules, security requirements, technical developments or new or modified functions. We will provide reasonable advance notice of material adverse changes. Adverse changes apply to a period already paid for only where they are mandatory or otherwise legally permissible. Mandatory rights remain unaffected.
